Orders Against Sun Network And Ntv Telugu News Channel....



T-Series once again strikes successfully by acquiring interim injunction orders against Sun Network Ltd and M/s Rachana Television Pvt. Ltd. who owns a 24 hours Telugu news Channel named ‘NTV’ before the honorary Delhi high court for using it’s copyright content illegally.

T-Series takes on seriously on usage of its IPR and inform all those broadcasters who are using its copyright content to make their TV soaps/ reality shows/ etc without paying license fee or for that matter have failed to renew their existing contracts and are still using their repertoire.

While keeping a close check on all the channels, it was found that Chennai based Sun Network and Hyderabad based Telugu news channel NTV were using T-Series’ content without the necessary copyright licenses.

Despite bringing these non-permitted usages to the channels notice on various occasions and having acknowledged by their respective heads, they continued with the infringements. Even after sending a draft agreement to NTV, it did not come forward to enter into license agreement and completely denied the usage of T-Series’ copyright content. Moreover it was claimed that the material used by NTV was the work of its creative department.

After sending many legal notices to the respective bodies, finally T-Series filed suits for infringements before honorable Delhi high court and subsequent to examining the documents on record and having considered the submissions of learned counsel appearing for it, Honorable Delhi High Court ordered in CS (OS) 1742/2009 that T Series has made out a prima-facia case for the grant of an ad interim ex parte injunction whereas in another case of copyright infringement, honorable Delhi High Court ordered in CS (OS) 1459/2009 I.A.-10152/2009 that southern major SUN Network Ltd would not use the content of any work over which T-Series has copyrights and if the network still wants to carry anything on their channel over which T-Series has copyright, they would seek appropriate license. The matter could have been resolved by paying heed to T-Series’ repeated reminders but such was not the case for most channels.

Divya Khosla Kumar, Creative Director, T Series says, “We have always been a serious player in this industry and to make music work among the masses, it is important that it makes money for the music companies who invest so much on songs and song picturisations. At T-Series, it is always a no-expense spared effort. Hence, we come down strongly on pirates and those violating the copyright laws. The current matter is subjudice and hence we would not be able to comment on it.”
